TERMS AND CONDITIONS
- Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian residents aged 18 years or over.
- Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- Promotion commences for purchases on 01/12/20 and close at 11:59pm AEDT on 31/12/20 (“Purchase Period”). Entries into the promotion open on 01/12/20 and close at 11:59pm AEDT on 14/01/21 (“Entry Period”), however entrants must submit their entries within fourteen (14) days of the date of Eligible Purchase (defined below).
- To be eligible to enter, individuals must purchase, one (1) eligible ASUS laptop (“Participating Product”) from an ASUS authorised retailer nationally during the Promotional Period (“Eligible Purchase”). Participating Products must be purchased in brand new condition (not second hand, refurbished or ‘slightly damaged new’ condition). Purchased means invoiced and paid for in full and delivered, unpacked and switched on within the Promotional Period, it does not include hired, rented or leased products. Commercial or business purchases of three (3) or more units and purchases made on eBay or similar online third party websites are ineligible.
- Participating Products and ASUS participating retailers are those listed in the schedule below.

To enter, individuals must, within 14 days of the date of their Eligible Purchase complete the following steps:
- (i) visit asuspromotion.com.au and follow the prompts to the promotion entry page;
- (ii) input the requested details including personal details, Participating Product model number, date of purchase, serial number, ASUS authorised retailer at which the Eligible Purchase was made;
- (iii) Upload a legible copy of their purchase receipt showing ASUS authorised retailer details (name, address and ABN), Participating Product model number, date of Eligible Purchase and confirmation that the Participating Product has been paid for in full; and if not completing the optional component of submitting a product review and claiming a free bonus prize (as detailed in clause 10 below)
- (iv) submit the fully completed entry form.
Note: once the entry form is submitted, an entrant cannot return at a later time to complete the optional component of submitting a review.
- Upon entry, all valid entrants will automatically be entitled to a $100 cashback off the purchase price of their Eligible Purchase. In addition, after submitting the entry form in full, entrants will then be directed to a webpage containing a ‘Spinning Wheel’, where entrants must click to spin the wheel. The wheel will randomly determine a prize at which point the entrant will be declared a provisional winner, subject to verification at the end of the Promotional Period. For the avoidance of doubt, winners of a prize will still be entitled to receive the $100 cashback off the purchase price of their Eligible Purchase.
- Limit of two (2) Spinning Wheel entries permitted per entrant, subject to the following: (a) only one (1) entry permitted per specified Eligible Purchase; and (b) each entry must be submitted separately and in accordance with entry requirements. For the avoidance of doubt, if multiple Participating Products are purchased in a single Eligible Purchase, the entrant is only entitled to one (1) entry for that Eligible Purchase.

FREE BONUS PRIZE CLAIM – In addition to entering to have the opportunity to win a Spinning Wheel prize, entrants have the option to also publish a valid product review (“Product Review”) for the purchased Participating Product to receive a free bonus prize. To be eligible to receive a free bonus prize, entrants must:
- (i) visit https://www.productreview.com.au/b/asus and publish a Product Review within fourteen (14) days of the date of purchase, as determined by the date on the valid receipt or invoice for the Eligible Purchase;
- (ii) take a screenshot of the Product Review;
- (iii) input the requested details at the same time as completing the entry form for the Spinning Wheel promotion, upload a copy of their Eligible Purchase receipt and upload a screen shot of their valid Product Review – the screen shot of the Product Review must clearly show the site URL where the Product Review has been made, and each of the valid Product Review criteria listed below; and
- (iv) submit the fully completed claim form..
The first one hundred and eighteen (118) entrants who submit a valid Product Review will receive an ASUS TUF Gaming Headset valued at $69.00. The next thirty two (32) entrants who submit a valid Product Review will receive an ASUS Cerberus Headset valued at $59.00. After the stock of 150 ASUS Headsets has been depleted, all entrants who submit a valid Product Review will receive a $20.00 Digital Prepaid MasterCard®.
For a Product Review to be deemed valid it must:
- (i) Contain a minimum of 25 words or more and include: how the Participating Product is being used, which features are liked and/or disliked and why the Participating Product was purchased;
- (ii) Be dated within fourteen (14) days of the date of Eligible Purchase;
- (iii) Be published in the same name as the entrant on the submitted claim form;
- (iv) Be in English and the product featured in the Product Review must be owned by the entrant; and
- (v) Be published on a https://www.productreview.com.au/b/asus.
- Limit of two (2) claims for a free bonus prize permitted, subject to the following: (a) only one (1) claim permitted per Participating Product; and (b) each claim must be submitted separately and in accordance with claim requirements. For the avoidance of doubt, if two (2) Participating Products are purchased in a single Eligible Purchase, the entrant is entitled to two (2) claims for a free bonus prize.
- Bonus prizes will be sent to the Australian address provided within the claim form. The address for delivery of the bonus prize on the claim form must be a current Australian street address and not be a PO Box or similar.
- Entrants must retain a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Purchase Period but prior to entry.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual or to refuse the giving of any prize, cashback or bonus prize to any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. ASUS will notify applicants if a claim is not validated for any reason. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
- Incomplete or indecipherable entries will be deemed invalid.
- If an entrant returns their Participating Product for a refund due to a change of mind, the entry submitted in relation to that Participating Product will be deemed invalid.
- If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
- At the end of the Promotional Period, provisional winners will be verified for eligibility and if verified to be eligible, the provisional winner will be declared a winner and will receive the prize originally determined by the Spinning Wheel upon entry. Any prizes on the Spinning Wheel that are not won by an entrant will be awarded by a second chance draw. Further, if any provisional winner is declared to be an invalid entrant, the prize(s) originally determined by the Spinning Wheel will also be awarded by the second chance draw. All eligible entrants who have not already won a prize will automatically be entered. Provided that any of the aforementioned prizes have not been awarded, the second chance draw will take place at 111a Orchard Street, Warriewood NSW 2102 on 27/01/21 at 11am AEDT, in the presence of an independent scrutineer if required.
- The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
- Provisional winners declared winners after verification will be notified by email before 27/01/21 and second chance draw winners will be notified by email within two (2) business days of the second chance draw. Winners names will be published on asuspromotion.com.au on 01/02/21. It is the responsibility of each winner to check their junk/spam email folder in case any correspondence from the Promoter has been redirected to this folder.
- The Promoter’s decision is final and no correspondence will be entered into.

Spinning Wheel prizes will be randomly determined and consist of the following:
- (i) $250.00 – four (4) in total to be won;
- (ii) $500.00– four (4) in total to be won;
- (iii) $1,000.00– four (4) in total to be won;
- (iv) $2,500.00– two (2) in total to be won; and,
- (v) $5,000.00– one (1) in total to be won.
Note: All Spinning Wheel prizes and cashbacks will be awarded in the form of a Digital Prepaid MasterCard. This will be SMS'ed to recipients after the verification process. Please note this product MUST be activated within three (3) months of being sent and is valid for twelve (12) months after activation.
- Any prizes awarded via the second chance draw will be awarded in descending order: the first valid entry drawn will win the highest valued prize, the next valid entry drawn will receive the next highest value prize and so on until all second chance prizes have been awarded.

Any ancillary costs associated with redeeming the Digital Prepaid MasterCard are not included. Any unused balance of the Digital Prepaid MasterCard will not be awarded as cash. Redemption of the Digital Prepaid MasterCard is subject to the terms and conditions of Edge Loyalty including activating the Digital Prepaid Mastercard before the specified expiry date which will be sent to the claimant when their Digital Prepaid Mastercard activation code is sent by SMS to the mobile phone number they provided when entering the promotion. Further:
- Entrants must allow up to eight (8) weeks from the end of this promotion, for claims to be processed and the prize(s), cashback and/or bonus prize(s) to be mailed out. Due to COVID-19 conditions, delivery time frames may be delayed and changed without prior notice. If unavoidable delays occur ASUS will endeavour to notify entrants of the delay. ASUS will not be held responsible for any lost or returned prize, cashback or bonus prize where the correct postal address is not included in the claim submission.

The bonus prizes given will be covered by the standard ASUS warranty applicable to this product if any.
- Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
- If any prize or bonus prize (or part of any prize or bonus prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Total game of chance prize pool value is up to AU$27,030.00.
- Prizes and bonus prizes, or any unused portion of a prize or bonus prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- A draw for any unclaimed prizes in the second chance draw may take place on 27/04/21 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the draw and their names will be published on https://www.facebook.com/asusaustralia on 29/04/21.
- Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to a force majeure event (meaning fires, floods, earthquakes, storms and other disturbances caused by the elements, riots, explosions, governmental actions, acts of God, insurrection, pandemic and any other cause which is not within the reasonable control of a party and not a direct obligation of the party under these Terms and Conditions), technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- Quality control errors will not invalidate an otherwise valid prize claim.
- Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any Spinning Wheel prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of / taking of a prize.
- The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.asus.com/au/Terms_of_Use_Notice_Privacy_Policy/Privacy_Policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
